Agreement to Terms
These Terms of Service govern your access to and use of the TailTales website, dashboard, AI pet creative tools, publishing workflows, APIs, and related services (collectively, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not use TailTales.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you use TailTales on behalf of a company, agency, creator team, or other entity, you represent that you have authority to bind that entity.
The Service
TailTales helps pet creators and teams turn real pet media into reusable AI pet identities and short-form video assets.
- Pet IDs, AI-generated reference sets, short-video generations, captions, content cards, and publishing tasks.
- Credit balances, paid generation reservations, successful generation settlements, and provider-failure releases.
- Publishing workflows for destinations such as TikTok, YouTube Shorts, and Instagram Reels through UniPost.
- Dashboards for projects, generated media, billing, publishing status, and workspace settings.
Account Registration and Security
- You agree to provide accurate account information and keep it current.
- You are responsible for keeping your authentication credentials, connected platform accounts, and any API keys secure.
- You are responsible for activity that occurs under your account, including uploads, generation requests, publishing instructions, and billing actions.
- You must promptly notify us if you believe your account or connected publishing destination has been compromised.
Your Content and Pet Likeness Rights
You retain ownership of photos, prompts, captions, generated outputs, and other content you submit to or create with TailTales, subject to any rights held by third-party platforms or providers.
You grant TailTales a limited license to host, process, transform, display, store, and transmit your content as needed to operate the Service, generate outputs, maintain your workspace, provide support, and publish content at your direction.
- You represent that you have the rights and permissions needed to upload pet photos and other materials.
- You may not use TailTales to impersonate others, violate privacy rights, misuse another person's or organization's brand, or publish content you do not have permission to use.
- You are responsible for reviewing generated outputs before using or publishing them.
Subscriptions, Credits, Fees, and Payment
TailTales may offer free access, paid subscriptions, and credit top-up packs. Plan features, credit amounts, Pet ID limits, and pricing may change over time.
Payment processor
Paid checkout, subscription billing, payment methods, invoices, and billing portal sessions are processed by Stripe. By purchasing a paid plan or credit pack, you authorize charges through Stripe according to the selected offer.
Credits
Credits may be reserved when you start a paid generation. Successful generations consume the reserved credits. Provider failures may release reserved credits back to your account when TailTales can confirm the failure.
Cancellations and refunds
You may cancel a paid subscription through account or billing settings where available. Unless required by law or expressly stated by TailTales, fees and unused credits are not refundable and partial billing periods are not refunded.
Acceptable Use
You agree not to use TailTales to:
- Violate any law, regulation, platform policy, or third-party right.
- Upload or publish content that is illegal, exploitative, harassing, hateful, misleading, spammy, or harmful.
- Use another person's, brand's, or pet owner's content without permission.
- Circumvent AI-content labels, platform disclosure requirements, usage limits, billing controls, security controls, or access controls.
- Reverse engineer, scrape, overload, interfere with, or attempt to extract source code or non-public data from the Service.
- Store or transmit malware, credential-harvesting content, or other malicious material.
- Use TailTales to compete with TailTales using non-public information.
AI Outputs and Publishing Responsibilities
AI-generated content may be inaccurate, inconsistent, incomplete, or visually imperfect. TailTales does not guarantee that generated content will match your pet perfectly, satisfy a platform's rules, or perform well with viewers.
You are responsible for reviewing outputs, captions, hashtags, titles, AI-content labels, and platform settings before publishing. You are also responsible for complying with the terms and disclosure rules of each connected platform.
Third-Party Services
TailTales integrates with third-party services including Clerk, Stripe, UniPost, AI generation providers, storage providers, hosting providers, and social platforms. Third-party services are governed by their own terms and privacy policies. TailTales is not responsible for their availability, security, content decisions, account actions, or business practices.
Service Changes and Availability
We may modify, suspend, discontinue, limit, or remove features at any time. We may also impose or adjust usage limits, credit rules, provider options, and platform support. We do not guarantee uninterrupted, secure, or error-free availability.
Intellectual Property
TailTales and its software, design, workflows, documentation, and branding are owned by TailTales or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.
If you provide feedback, suggestions, or ideas, you grant TailTales permission to use them without restriction or compensation.
Termination
We may suspend or terminate access if we believe you violated these Terms, created risk for TailTales or others, failed to pay fees, or used the Service in a way that could harm connected platforms, providers, users, or the public. Upon termination, your right to use the Service stops immediately.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILTALES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, PLATFORM ENFORCEMENT, OR FAILED PUBLISHING RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILTALES' TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO TAILTALES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless TailTales from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your content, your publishing activity, your violation of these Terms, or your violation of law or third-party rights.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Francisco County, California, unless applicable law requires a different forum.
